Terms of Service

Insomniac Agents ("Insomniac Agents," "we," "us") is an independently operated software product, based in Australia. These terms govern your use of the Insomniac Agents website, dashboard, and the AI agents it runs on your behalf. You can reach us any time at reid@allegianttechnology.net.

By creating an account or using Insomniac Agents, you agree to these terms. If you're using it on behalf of a company, you're confirming you have the authority to bind that company to them.

You describe a business idea, and an AI agent researches it, drafts supporting documents, builds and deploys a website, and proposes follow-up tasks. On a paid plan, the agent also runs scheduled "night shift" work sessions against your task queue.

The agent is an AI system. It can misunderstand your brief, produce inaccurate research, or write copy that needs editing. Review everything it produces — the mission doc, market research, site copy, and any drafted communications — before you rely on it or send it to a customer.

You're responsible for the activity on your account and for keeping your login credentials secure. You must be able to form a binding contract to create an account — we don't knowingly offer accounts to anyone under 16.

• Free plan: no cost, one company, limited to a handful of proposed tasks for you to review.
• Launch plan: $20/month per agent, includes up to 30 night shifts a month, running tasks on demand at any time, and unlimited strategy chat — subject to the fair-use AI budget below.
• Subscriptions are billed monthly and can be cancelled anytime from Settings → Billing. Cancelling stops future billing.
• Refunds: new paid subscriptions are covered by a 30-day, no-questions money-back guarantee — see our Refund Policy. Outside that window we don't offer prorated refunds for partial months.

Fair-use AI budget. "Unlimited" strategy chat and on-demand runs are subject to a fair-use AI budget that stops automated abuse or runaway loops from degrading the service for everyone. In normal use you won't reach it. If your agents do hit the budget, we tell you in-product rather than failing silently, and it resets on a daily and monthly cycle.

The business idea you describe, and everything the agent generates for it — the site, its content, documents, and drafted posts — belong to you. We build and host your site for you on Vercel, under our infrastructure accounts, and it goes live at a real URL. If you leave, or any time you ask, we'll export your site's files and content so you can host them yourself.

You agree not to use Insomniac Agents to:

• Build or run a business that's illegal where you're operating it.
• Generate content that's fraudulent, deceptive, or infringes someone else's rights.
• Attempt to abuse, overload, or reverse-engineer the agent infrastructure.
• Resell access to the service without our written agreement.

We can suspend or terminate accounts that violate this section.

You can close your account at any time. We can suspend or terminate access for violation of these terms, non-payment, or if we discontinue the product — where reasonably possible, we'll give you notice first so you can export your site's content and files.

Insomniac Agents is provided "as is." We don't guarantee that AI-generated research, copy, or code is accurate, complete, or fit for any particular purpose. To the extent permitted by law, our liability arising from your use of the service is limited to the amount you paid us in the 3 months before the claim arose.

These terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.

We may update these terms as the product changes. We'll post the updated version here with a new "last updated" date; material changes will also be emailed to account owners.
